User’s Terms and Conditions

These Users Conditions describe the terms and conditions applicable to the use of the Internet service provided by MarketMeeting.com (from now on, the Website) through its website, the websites of its international branches, and other associated websites. The Web is owned by the Gabinete Informático de Galicia, S.L., with business address at C/La Estrada 47-49, 15702 - Santiago de Compostela (A Coruña), CIF (Fiscal Identification Number) CIF B15436181, registered at the Company Registration Office of A Coruña, Volume 1387, General Section, Folio 94, Sheet C-9797, 1st Inscription of 11/11/1993.

1. Inscription. By ticking off the section I agree and accept the Users Terms and Conditions of the inscription form and clicking on the Send button, you will be registered as a User, and commit yourself to accept the terms and conditions described below, concerning the use of the service provided by the Website.

All the products and services contained in the Website are provided in conformity with the present law concerning tele-matic services. The services of the Website will only be available to natural or corporate persons with the capacity to subscribe a valid conformity contract in accordance with the applicable law.

2. Participation. Only you are liable for the information contained in your advertisement or proposal, and in all the communications held with other Users of the Website, and thus you must agree to accept full responsibility for your actions, in terms of their compliance with the applicable law. Also, Users are subject to certain limitations within the context of the present Users Agreement, and must be in agreement with and accept full responsibility for their actions in terms of their compliance with the applicable law. The Website will not be held responsible for the lawfulness of the Users actions.

Rates and Services

Any User may accept ads or proposals for free. If another User wishes to make contact with the ads or proposals placed in the website, he/she will need one of the following subscription packages:

- Free Contact Service. When inserting an ad, users may choose the Free Contact payment option, which will allow other users to make free contact in relation with their own ad or proposal.

Free Contact	If upon publishing your announcement you decide to purchase the Free Contact option in order to increase the visibility and dissemination of your ad. This means your ad will always appear before the rest of the ads, both on the website and on all the weekly news bulletins containing the free ads placed each week, for 90 days. Also, other users may contact you through the website or directly through your contact data, without having to purchase 1 credit or a subscription package.	8,95 ¬

The rates do not include VAT (18%). The Value Added Tax is an indirect tax on the consumption of goods and services, such as the services provided by the Website, and is applicable in conformity with the law as of July 1st, 2003, to residents, or people with a permanent address, in a country of the European Union.

Payment of the rate will enable Users to make contact with the ads or proposals of other Users in accordance with the service acquired. Contact with other Users is possible almost simultaneously upon validation of the transaction by credit card for the amount established for the service in question.

The Website will be entitled to alter the Rates and Services Policy at any time, always in compliance with the terms established above. The Website may temporarily modify its service rates due to promotions (for example, free insertion days), and such modifications will become effective when the promotion appears on the Website.
When inserting ads or proposals, you will have the opportunity to revise and accept the rates to be charged for the use of the insertion services. The Website may modify all or some of the services at any given time. Should a new service be introduced, the rates for that service will be effective when the service is launched. Unless otherwise indicated, all the rates are in euros. You are responsible for the payment of all the rates deriving from the use of the services of the Website, as well as all the applicable taxes.

What is a Subscription Renewal?

The products you have subscribed to may be renewed during the last seven days prior to the expiration date of your ad or proposal. Our system will send an alert message to your e-mail address a week before the expiration date. You may also monitor your expiration date through your personal My Purchases option. This will ensure your uninterrupted access to the packages you are subscribed to at a much lower cost. If you have acquired a Free Contact package, you will appear continuously on the website.

3. Contents of the ads and proposals. The Website will not accept ads or proposals seeking publicity for pyramid or multilevel (MLM) businesses involving transactions with illegal products or breaking the law or using inappropriate or explicitly offensive language. Such ads and proposals will be eliminated without warning and without the possibility to be modified. In the characteristics and conditions of an ad will not include information concerning the identity of the advertiser, such as name, phone number, website, e-mail address, ICQ number, mail address or any other contact information.

4. Communications with other Users. You will not abuse other Users by trying to contact them when the have clearly expressed their desire not to have any communication with you. You will do your outmost to behave in an ethically acceptable manner with other Users. Should you break the applicable law, or fail to observe any of the clauses of this Users Agreement, you will held responsible, and consequently you will exonerate the Website from any legal suits or proceedings against you in relation with this clause, which might lead to your starting legal proceedings against the Website. The Website advises you there are certain risks involved in dealing with the Internet Users located in other countries or people acting under false identities or pursuing unlawful aims. It is difficult to identify such people on the Internet. Thus, the Website cannot guarantee all the Users are who they claim to be. You must be careful when dealing with other Users.

5. Responsibility of the Website:

I. The Website acts as a meeting point on the Internet between the business supply and demand existing in the marketplace and providing a communication channel for Users offering and seeking business opportunities. The Website will not be held responsible for the veracity of the information submitted by the Users. The Website will not be held responsible for any subsequent actions deriving from the agreement related with an ad or proposal published in the Website, including the economic transactions.
The Website will not become involved in any negotiation among Users. This way, the Website has no control whatsoever over the quality, safety or lawfulness of the ads and proposals posted, the veracity or accuracy of the ads, the capacity of the sellers to sell articles or the capacity of the purchases to purchase items. The Website cannot guarantee a given transaction will be completed.

II. Our company reserves the right, without limitation, to dismiss any User who fails to observe these terms and conditions if there is reason to suspect a customer may be involved in any kind of fraud or illegal activity in relation with our service, at any given time and without prior notice, and to automatically erase messages which can be considered inappropriate, as well as to stop the full or partial publication of ads or proposals and/or block access to all or part of the services, temporarily or for good, without any compensation or reimbursement. Should the Website cancel or terminate your service due to any of the reasons described above, or any other reason, the Website will have no obligation with you. By behaving unethically, you waive all the right acquired when hiring the services of the Website.

III. The Website will not authorise the insertion of offensive o inappropriate ads or proposals. To be inserted, ads and proposals must comply with the specifications of these Terms and Conditions and will not be placed until all offensive parts have been withdrawn.

IV. Should a demand or a request to withdraw an ad come to the Website from any government courthouse, department or agency, the Website will withdraw the ad immediately.

V. Should you cancel or terminate your account due to any of the reasons established in these Users Terms and Conditions, the Website will not be obliged to you in any way. By doing so, you waive all the rights acquired in relation with the Website as a result of your inappropriate conduct.

VI. The Website will not be held responsible for any information received through this service.

VII. The Website is entitled to change the terms and conditions at any time, showing the changes on the website. You (and the rest of the Users) are to comply with the terms mentioned from that moment onwards.

VIII. The Website is under no obligation to ensure that all Users comply with the terms bad conditions, despite the fact that these terms and conditions specify unacceptable conducts in our service. The Website will not be held responsible for any information received through this service.

IX. Under no circumstances will the Website allow Users to break the rules of the service we provide, in order to avoid negative consequences or indirect damages. Also, our company will not be held responsible, within the prevailing law, for the actions or omissions performed by the Users of the service. However, this Users Agreement does not intend to restrict or exclude any legal liability the Website might incur as stated by the applicable law. If you do not notify the Website, within 30 days, about such conduct in relation with our requirements, actions, legal suits, proceedings or appeals, the Website will not be liable for any action, legal suit or proceedings started against it. Our company will not be responsible for any information received through this service.

6. Use of the Website by Users

I. Due to the fact that the Website cannot be involved in any User-to-User communications, should you have a conflict with another User, you will hereby exonerate the Website (and our agents, associates, affiliated bodies and employees) from any appeal, suit or damage (present or subsequent) of any kind or nature, known or unknown, foreseeable or unforeseeable, disclosed or undisclosed, deriving from or in relation with the specific conflict. The Website will not be held responsible for any information received through this service.

II. Only the User is responsible for the information supplied in his/her ads or proposals (as to the information contained in them), as the Website remains a passive channel ensuring the distribution and publication of such information on the Internet. Nonetheless, the Website may take any action, in relation with this information, deemed necessary or appropriate, in an exemplary fashion, should the Website consider this information may bring about legal liabilities to us or cause us damage (total or partial) in order to access the service of our ISP servers or any other server. In these cases the Website will be entitled to alter or withdraw all or part of the information contained in the ads or proposals. Our company will not be held responsible for any information received through this service.

III. The Users will ensure that the information contained in their ads or proposals is accurate and reliable. Such information will not contain false, inaccurate, deceiving or fraudulent data, will not be concerned with the sale of forged or stolen articles detrimental to the intellectual ownership, patents, brands, industrial secrets or other intimacy, publicity and intellectual rights of third parties, or any products or articles that fail to comply with the law, regulations and norms (including, in an exemplary fashion, the regulations concerned with the control of changes, the defence of consumers, unfair competition, non-discriminatory or deceiving advertising), will not be defamatory nor constitute slander, threat or coercion, nor obscene, nor will contain child pornography, nor any virus or other computer programming routines which may damage, interfere or surreptitiously intercept or expropriate other systems, data or personal informations, nor will establish direct or indirect links nor include descriptions of goods or services forbidden by these Users Conditions.

When meeting the conditions necessary for inscription, Users will be provided with an identifier and a password, which are strictly personal and confidential and will not be communicated nor shared with third parties. The Website will not be held responsible for any identifiers and/or passwords lost by the Users. Only the Users are responsible for their identifiers and for the actions carried out or the statements made through the message tools provided by the Website. The Users exonerate the Website from any responsibility regarding legal suits in this respect. On the other hand, given that the Website does not have the means to ensure the identity of the persons registered in its services, the company will not be held responsible for any identity usurpation performed by any of the Users.

7. Privacy. As to the use of the services provided by the Website, the Users must provide certain personal data. The Website will process those personal data by means of automated files for the purposes described in the conditions included in the Privacy Policy of the Website, which becomes incorporated to the present Users Terms and Conditions by reference from this clause.

8. Intellectual and industrial property. The Website owns the intellectual property rights of the contents of the websites, the graphic design and the codes, which, consequently, will not be reproduced, distributed, publicly disseminated, transformed or used for other activities, not even mentioning the source, without the written permission of the Website.
Also, all the commercial names, brands or logos of any kind contained within the Website are the property of their legal owners and protected by law.

9. Legislation. This Users Agreement will be used and interpreted in accordance with the Spanish law. All the users of this website are subjected irrevocably to the jurisdiction and exclusive competence of the Spanish courthouses and tribunals. Our company will not be held responsible for any information received through this service.
The clauses of this agreement are varied. Should any of these clauses be considered invalid or inapplicable, such clause may be eliminated, keeping the rest of the clauses in place.
The fact that the Website may take action in relation with a violation on its part in relation with this Users Agreement does not cancel our right to take action in relation with subsequent or similar violations.

This Users Agreement will not be interpreted against us due to the exclusive fact that it has been produced by the Website.
Also, this Users Agreement requires the understanding and agreement between the Website and yourself on this issue.
